Can there be a differentiation between extensions/renewals/company changes and new H1bs?
In some sense there already is, since the former are not subject to cap, while the latter are.
So, why not extend the same argument to other situations?
Get an LCA and impose all kinds of restrictions on new H-1Bs, but don't apply these on existing H-1Bs, especially if they have had their labors filed.
That way, they don't get rid of existing H1B employees.
They only make it harder for new people to get H1bs. Which, it is my understanding, is not our fight.

Instead of getting rid of all H1B employees in one full swoop, this lobby wants to put law in place where new H1s will be mostly rejected due the "Consulting clause" and existing H1 employees will be hit in the head with a 2 X 4 when renewing H1, since the scrutiny and paperwork is the same for new H1, H1 extensions and H1 transfers. Same LCA filing, same I-129 forms.
So instead of immediate purge, this is like getting rid of 5 to 10 thousand each month by making extensions and renewals and transfer impossible for those doing the consulting.

I realise that it is a little unorthodox to apply �on spec� for such a high-ranking position within your organisation, but I believe I have the necessary skills to further increase the profits and assets of Big Bank Plc. In this letter I will attempt to demonstrate my knowledge of the challenges and opportunities in our marketplace.
1) Who are our customers?
I understand that our most lucrative customers are those with the least awareness of financial matters; indeed, the less numerate they are, the better. Rather like the dear old PM, in fact.
If they don�t know the difference between APR and AER, if they fail to read the small print in their credit contracts - not that it matters, as I�m sure I have the necessary legal skills to make such text impenetrable - and if their limited attention is grabbed by an �introductory� rate, then they are exactly the kind of people we need to target.
I think that if we closely follow that other highly successful model of commerce - drug dealing - we won�t go far wrong in attracting and retaining the right customer base.
2) How do we get people to take on more debt?
I�ve been thinking about this, since we need people to be in debt so that they pay us lots of interest. I believe the best way is to start with an asset class that everybody needs and arrange for its price to increase by far more than the general inflation rate. Then the people who want to buy the new, over-priced assets will have to take on far more debt than would otherwise have been the case.
Of course, the people who bought the assets prior to the excessive price inflation wouldn�t be in debt, but I think we can get around that by encouraging them to take on larger loans for, say, holidays, new TVs, big cars, that sort of thing (maybe even encouraging them to buy more assets to loan to other people?), all while securing them against the now-increased �value� of their asset. We could describe these loans as �Asset Equity Release� or something; it sounds so much more friendly than �Borrowing a Lot of Money.�
Ultimately this would mean that everyone is in far greater debt, paying us far more money, for exactly the same asset! Genius, eh?
Oh. Hang on. That�s already been done with houses, hasn�t it?
3) Social conscience.
Every responsible company should have a social conscience, and Big Bank Plc is no different. We need to be in tune with the society in which we operate, sharing the values of our customers.
Luckily that�s not too difficult; our customers are greedy and so are we! They want lots of money, right now. We want lots of money, but we can wait (that old �deferred gratification� thing).
So we simply sell them the money to fulfil their greedy dreams, and they sign up for a lifetime of debt slavery to fulfil ours. Everyone�s a winner!
4) Get-out.
I have noticed that some of our customers have been attempting to escape from their obligations through IVAs, bankruptcy and so on. This really won�t do. Luckily we have a role model to follow here; America. The banking industry there successfully lobbied Congress to make it almost impossible to escape from credit card debt, even in bankruptcy.
There�s much work to be done in the UK by comparison, but we�re getting there. Escape from student loan debt is almost impossible and an IVA won�t release people from mortgage debt. There�s still credit card debt, but at least we can now secure that on property (I love that one; we sell an unsecured loan at punitive rates, then secure it! They�d have been better off just getting a secured loan! How stupid are these people?).
So, there�s just the problem of escape through bankruptcy, but I think we can work on that. Friends in government, nudge nudge, wink wink. Give me time�
5) Our friends at Westminster.
Speaking of government, I think our special relationship is going rather well, don�t you? They want a population that feels wealthy even though it isn�t (see number 2 above), that is unlikely to cause trouble (who can afford to go on strike when you have huge debts to service?) and that isn�t educated enough to understand what�s being done to them (have you seen the latest exam results?).
Those are our goals too; it�s a marriage made in heaven. And if they want to rack up even more debt on the population�s behalf, we�re only too happy to oblige.
We do need to be more careful at times, though. Our so-called competitor�s �employment� of that ex-Prime Minister so soon after leaving office was rather rubbing people�s faces in it, don�t you think? A few of the less stupid ones might start to put two and two together.
6) Media
Can we keep the mainstream and financial media �on-side�, thus keeping the population distracted by pointless celebrity gossip, �reality� TV programmes (oh, the irony), diversionary economic scare stories and back-to-back shows extolling the virtues of never-ending asset inflation (and with it, never ending debt)?
Of course we can - we own most of them! And the government owns much of the rest. Anyway, people actually seem to want this stuff. Bread and circuses, I suppose.
7) What happens if we run out of money?
See number 5. There are plenty of options if we ever run into difficulties - direct government �loans� (rolled over ad infinitum), dropping the base rate below real inflation while raising lending rates, etc. - but they all boil down to one thing: take money from the tax-payer while using inflation to mask the theft. With a bit of luck we can even get the public to demand this action for us, with the help of the media.
And anyway, we�re not actually lending real money, are we? It�s created from nothing at the point at which the loan is granted. So what do we have to lose?

Economists and western political leaders love to compare India and China, and it�s an understandably irresistible comparison: They�re both rising Asian economies with more than a billion people, and neighbors to boot.
On India Real Time we�ve done a little of that ourselves from time to time.
If you�re pressed for time we can sum it up like this: China has more of everything (except poor people.) If you�re not, here are five blogs that stacked India and China up against each other on different indicators in the past year.
Warren Buffett: The billionaire from Omaha so far has appeared to be leaning a bit more towards China, at least in terms of investments. Mr. Buffett�s company, Berkshire Hathaway Co., holds a sizeable stake in Chinese battery and auto-maker BYD Co. And Mr. Buffett visited in September, along with Bill Gates, hoping to convince Chinese billionaires to give away more of their wealth to charity. The love is returned, with a Chinese man having paid a record $2.1 million to have a one-on-one lunch with the investing wizard.
Mr. Buffett has said that he�d like to invest in India but his plans have been stymied by caps on foreign holdings in insurance.
However, India can at least look forward to hosting him in the new year. The billionaire announced at a shareholders� meeting this year, in response to a question from a young Indian-American, that he plans to visit India in 2011, perhaps in March.
The big-ticket event: India hosted the Commonwealth Games in October, China hosted the Asian Games in November. Of course, China�s already hosted the Olympics�and how�so it hardly seems fair to compare the two.
But we did anyway. The news coverage of the Indian Games was rife with words like �delays,� �corruption,� �shambles� (we�re pretty sure that was the British press) and �filthy� until the opening night extravaganza quelled criticism for a bit.
China, it appeared, had lovely, shiny venues ready to go about five months ahead of the event, so it could spend the final days flicking away little specks of dust from its Games merchandise.
Their middle classes: According to a report on Asia�s middle classes this year, India still has about 650 million people living on under $2 dollars a day measured in 2005 purchasing parity dollars.
China now has less than 100 million living on that amount. Yet there was a time, as recently as the 1990s, when the two countries had similar numbers of poor. China has just done a better job of lifting people from that bracket into the middle class, and not just onto the next rung �the $2 to $4 range, where a majority of India�s middle class folks fall.
The majority of Chinese now fall in the �mid middle class� category that can spend $5 to $10, a group whose numbers appear to have quadrupled between 1995 and 2007.
But don�t blame the slower rate of reduction in poverty on India�s political system, says John Lee of the Sydney-based think-tank Center for Independent Studies.
The economy, stupid: China is still a much bigger economy than India, even though the two countries have roughly similar numbers of people. At a Hindustan Times conference on India, Shashi Ruia, chairman of Essar Group, compared the two countries on steel production, car production and trade.
As we already said, China does more of everything. The gap is undoubtedly glaring on roads, electricity production, trains and other infrastructure.
Surfing: India�s and China�s online populations belong to different worlds, judging by their Google searches. India appears to be firmly embedded in the English-speaking western world, looking for products like Nokia and applications like Facebook, Yahoo! and YouTube, although when it comes to films, it�s all Bollywood. China seemed to be the reverse�relying largely on Chinese applications but much more likely to seek out Hollywood films. They did have this much in common though: outr� pop star Lady Gaga.

Good points. If I recall correctly baby boomers started retiring 2-3 years ago. With economy going south, I wonder how many of them are in financial trouble. Many people don't really understand the investigative powers uscis has or the extent they will go through. if person fakes paystubs to do an h-1b transfer; well uscis issues rfe's asking for a listing of all h-1b employees and payments made to each employee for last two years. I have seen them inter-relate this information for people who have faked these types of things.
Recently; I saw uscis california service center request state unemployment compensation reports for all employees for wages paid for the last two years. ..
These two types of documentation were requested by US Consulate, Chennai for issuing H4 visa for my wife. I had to get these documents and send to india for stamping. They issued H4 immediately after reviewing the documentation. I have not faked any documentation. They have requested these documentation based on the assumption that my employer is letter pad company.

After looking into above message...I have some doubts, could you please clarify them.
1. In order to file 485, the person must have a valid visa in his passport?
In my case I have a valid I 94 but my visa got expired 2 months back, Am I eligible to file 485?
2. What is auto revalidation?

No; you don't have to have a valid visa in your passport to file the 485. You are just supposed to be in non immigrant status (ie., f1, f2, h1, h4, etc.). Your I-94 card if expired; should not have expired more then six months prior to filing 485.
Auto revalidation is one of the neatest little escapes to gettting back into proper status. Essentially; when entering into usa; one needs a valid visa to enter. However; auto revalidation is when a person goes to Canada or Mexico; stays less then 30 days; doesn't try to visit another country; doesn't attempt to go for visa stamping; has a valid/unexpired I-94 card (this also means unexpired I-94 card on a notice of action) then you can re-enter usa without a valid and unexpired visa.
This concept is actually very difficult for people to believe that if their visa is expired but they have a valid i-94 card that they can go to canada and re-enter usa without a visa. since you are resetting your date of last entry by going out and coming back in then it helps greatly in using 245k since you have reset the date of your last entry into usa.

Unable to garner enough votes from their own party, House Democratic leaders had to turn to Republicans to win passage of a $555 billion domestic spending bill after the Senate appended $70 billion to it for the wars in Iraq and Afghanistan. The Democratic leaders again had to appeal to Republicans to win passage of a measure to stave off the growth of the alternative minimum tax, because fiscally conservative "Blue Dog" Democrats were in open revolt and refused to go along. Needing two-thirds of the House to pass under fast-track rules, the tax measure was approved 352 to 64, with all 64 "no" votes coming from Democrats standing by their pledge not to support any tax cut or mandatory spending increase that would expand the national debt.
The year's finale angered the entire spectrum of the Democratic coalition, from the antiwar left to new Southern conservatives who helped bring Democrats to power last year.
"This is a blank check," said Rep. Jim McGovern (D-Mass.). "The new money in this bill represents one cave-in too many. It is an endorsement of George Bush's policy of endless war."
Still, the Democrats delivered much of what they promised last year. The military prison at Guantanamo Bay, Cuba, remains open. Bush's warrantless surveillance program was actually codified and expanded on the Democrats' watch. Lawmakers were unable to eliminate the use of harsh interrogation tactics by the CIA.
Democratic leaders also could not overcome the president's vetoes on an expansion of the State Children's Health Insurance Program, despite winning over large numbers of Republicans. Policies that liberals thought would be swept aside under the Democratic majority remain untouched, including a prohibition on U.S. funding for international family-planning organizations that offer abortions.
Efforts to change Bush's Iraq policies took on the look of Pickett's charge at Gettysburg. You are probably talking about a thin % of peoples - this is a lame argument for most of the Eb3 folks who can and want to port to Eb2 legally.
Let me give you my case. I was eligible for both EB2 and EB3 when my GC labor was filed - my employer filed it in EB3 because the queue is longer and i remain with them for longer duration. I had about 390 days of H clock left so arguing with that employer and finding another one was also not an option because for getting H extension beyond 6 yrs needs the GC labor to be more than 365 days old.
By the way I've seen the horrors of Labor Sub , I've suffered BEC cold storages for years,now I'm struggling with my Eb3 140 for 15 months at NSC and after all that if i port to EB2 and get my 485 quickly - what Problem you have or what's wrong in that ?
Good points, but let me put a counter argument. Two people , one is named SunnySurya and the other is named Mr XYZ. Both came to the USA at the same time in 1999. The difference was SunnySurya came here for his masters and the other guy came here through shady means.
Mr XYZ was able to file his green card in 2002 in EB3 category based on his shady arrangements with his employer, whereas Mr SunnySurya continued to do right and socially acceptable things i.e. studied, got a job and then after several years this big company filled his green card in EB2 category in 2006.
On the other hand after strugling for several years Mr. XYZ has collected enough years on his resume to be elligible for EB2. Now he want to port his PD

If the asking price now is same as the price then + 1-2.5% price appreciation per year to adjust for inflation then it's a reasonable price. Ignore the peak around 2005-2006.
If your purchase price meets both these criteria you know you have a good deal. Go ahead and buy.

Other than in a few areas like Detroit and Miami, the home prices are close to stable and are not heading to fall another 10%. When people write articles they want to sensationalize thier reports. What's happening in Detriot will not be happening everywhere in the nation. Real estate markets are very local and cannot be generalized. So anyone that is thinking that there is going to be another HUGE drop in home prices are mistaken.

Per my understanding, it absolutely is. An LCA amendment has to be filed each time there is a location change outside of commutable distance from the original location for which the H-1B was filed.

Do you even realize that the beauty of democracy, as flawed as it might be in India, is that you get to choose who represents you and the people have the right to choose how they should be governed through their elected representatives. Why is it that there are no true democracies in the middle east? Have you ever thought of that? Do you realize that in a country like Saudi Arabia women are oppressed and they have to follow the dictates of the mullahs!! Every person, irrespective of their personal faith is subject to the Sharia laws!! Is that justice!! Why is it that Muslims don�t see oppression within their own country and try wage a jihad against that? Why is it that Muslims don�t want to spend time and effort cleaning up their own house?
Here is some free advice for you, first up why don�t you and any others who feel that Muslims are being oppressed in parts of world where Muslims are a minority wage a jihad in Muslim majority countries and free your society from the injustice that are being passed out to the population in the name of Islam. When I see you do that and that will be day you will be able to point your fingers at other countries. Buddy, first get your house in order before you start pointing fingers. He has given so called "RATIONAL" explanation in SUPPORT of TERRORISTS involved in Gujarat massacres. I think he is holds some rational views and I try to see if I dig his personnel information and inform relevant authorities. He is crying out to be spanked

I love to see Obama in White House too. My only concern is who drives his Immigration Policy. Sen. Durbin? The provisions in CIR 2007 were scary.
I am here legally in this country from Sept 2000.
Applied for GC in March 2006 (EB3 I), filed 485 in July 07, used AC 21 in April 08 and now working on EAD.
I already had backup plan for Canada. If I wanted to keep my Canadian PR current I had to fulfill the 2 yrs out of first 5 requirement and was required to relocate to Canada in Aug 07. After July 07 fiasco and getting EAD, I thought of giving up on that back-up plan. It was not an easy decision, but we decided to bite the bullet and were thinking that AC-21 memo and EAD are good enough safe-guards for any denial if and when it comes. Also other thing I thought as it is it's going to take ages for my date to become current by that time at least my child's education will be done (he is in high school) and he doesn't have to go through relocation pains as far as school is concerned. He has already done that 4 times in last 8 years. So all in all we were satisfied with the decision to abandon Canadian PR and using AC 21. But now all of a sudden I see there are so many denials for straight forward AC21 cases and moreover if Obama wins then immigration policy are driven by Durbin. AC-21 is the thread that I am hanging on to, if that goes away then what....just don't want to think about it.
Correct me if i am wrong, But, The general feeling that i am getting from this whole discussion is that, If Obama becomes the next President and if his Buddy Se. Durbin is driving the immigration issues then , Are they going to scrap all the pending Employment Based GCs, and, all the People who have already used AC21 will be in trouble, thats like starting the whole thing over again.
I personally think that this will not be the case and the new laws will be applicable to the new applications, because, when you invoked AC21 you did it according to the law, how come you will be in trouble because of a new law.
Its like saying , If a crime of theft is going to have a Death panelty starting 2010, then all the convicted people from past will be hanged in 2010." That somehow doesn't sound right...I would like to get opinion from other people.

I guess the only way US of A will ever understand its worth in the world is when: (I am just referring to hypocritical US of A'ans, there are good people too.)
1) India and China stop sending so many Engineers and doctors.
2) China and south-east Asia stop supplying Nike's and toilet paper to Walmart's
I guess the positive side of this H1 bill will be further development of Indian and Chinese economies via decreased brain-drain. I guess it already slowed down (to a trickle?!) quite a bit in the past few years and I Hope this bill plugs the leaks too. Hurray! No more brain drain from India and China.
Why didn't this happen a few years ago and I wouldn't even have had any regrets being in US of A ever. Yikes!
