Hi all,
This is urgent, your response is appreciated. I am switching jobs and my new employer wants me to go to the UK for some training in a week for about 5 days. They are sending the H1-B transfer application in couple of days, so the transfer has not been done. The img. lawer said they will send the receipt notice to me in the UK and I could travel back with my previous H1-B visa from my previous employer. I am a citizen of India woking in the STEM field for the last 2 years. I am still working and my employment will last for about 1 more week.
QUESTIONS:
1. Please let me know you see any problems at immigration when coming back to the US?
2. Can the employer wait couple of more weeks before sending cancellation of my H1-B visa without paying me during that time?
3. If I take an unpaid leave durimg this time, will that help?

Hi All,
My EB3 RIR is filed on Feb 2005. Waiting for LC to clear. Also H1B expires on Jun 2007. Waiting for H1B extension for another 1 year.
I would like to change my job once I get my H1B extension.
1) Can I change my Job during my one year H1B extension when my LC is not cleared?
2) Can I use my current PD (Feb 2005) when my new Company process LC again through EB2 PERM?
3) From the new company, once I get LC through EB2 PERM, can I apply H1B extension for 3 years?
Please advice. Waiting for you reply.

Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

The Congressional Hispanic Caucus has sent a letter to the President asking him to terminate the controversial 287(g) program that allows local police to enforce immigration laws on behalf of the Department of Homeland Security. The CHC expressed its concerns about allegations of serious civil rights violations against Hispanics as well as recent reports of poor oversight in the program. The National Council of La Raza, the country's largest Latino civil rights organization praised the letter.

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..

i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.

Hi all,
I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

My details:
India/EB3/PD:Sep2003/I140 Approved.
I485/EAD/AP: Recevied July 28
I completed FP appointment last week (Wednesday), but LUD has not changed since then.
Also EAD status changed twice (before undergoing FP) it said Card Production Ordered. Today it changed to Approval Notice sent.
Questions:
1. Is there any relation between FP and EAD ? (e.g. Prints appear on EAD etc)
2. Is that the right sequence in change of status:
"Card Production Ordered" followed by "Approval Notice Sent".

My ead card production ordered. I efiled on April 27th.
Rediculous, the processing times say it takes 90 days minimum. Hopefully they will give the extension from my expiry date which is Aug 28th 2008.
As USCIS is saying they will issue 2 year ead starting Jun 30. certainly I will not get a 2 year EAD.

My wife got H1B approved in this year cap with validity date from October 1 2009. She is going to India for vacation during August 2009 and planning to go for H1B stamping.
My question is, whether she can go for stamping before October 1, 2009 which is the start date mentioned in I797 or she should go for stamping only after October 1,2009 ??

My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!

JUST before Congress adjourned for its August recess, Democrats engaged in a flurry of legislative activity, while Republicans complained about a �do-nothing� Congress�s meager policy accomplishments. Deep partisan differences, narrow majorities and a Republican in the White House have frustrated Democratic ambitions and fueled a toxic atmosphere in both chambers of Congress. The public�s low approval ratings reflect broad discontent with the direction of the country but also displeasure with Congress for failing to reverse course on Iraq and for continuing the bitter partisan warfare.
But has this really been a do-nothing Congress? The circumstances are similar to those in 1995, when a new Republican majority in both houses took office under a Democratic president. So perhaps the best question to ask is, how is this 110th Congress doing compared with the 104th Congress, in 1995?
Both new majorities began by spending more time in session, holding more committee meetings and roll call votes, and passing more substantive measures than the Congress before them had. At the same time, in both cases, the number of bills signed into law by the president from January to August dropped.
Still, the Democratic Congress�s legislative harvest this year has been bountiful compared with that of its Republican counterpart in 1995. Back then, the Republicans� Contract With America was stymied by opposition from the Senate and the president. The new Congress has enacted a far-reaching lobbying and ethics reform bill, an increase in the minimum wage, recommendations of the 9/11 Commission, foreign investment rules and a competitiveness package, and has embedded a number of major initiatives and new priorities in continuing and supplemental spending bills. Democrats also made headway on energy, children�s health insurance, college student loans, Head Start, drug safety and a farm bill � though much of this awaits action in the Senate or in conference and faces a possible veto.
During the first seven months of 1995, Congressional oversight of the executive branch increased modestly in the Senate but not at all in the House. But this year Congress, especially the House, has intensified its oversight, following years of inattention and deference by its Republican predecessor.
Democratic promises to restore civility and regular parliamentary procedure by allowing the minority party a larger role in deliberations have foundered. The number of restrictive rules for debate has increased, and the conference process has been short-circuited on various occasions.
In the Senate, Republicans have made the filibuster, or the threat of filibuster, routine, setting a 60-vote hurdle for all contested legislative matters. This has led Harry Reid of Nevada, the majority leader, to file many more petitions for cloture than Bob Dole, his counterpart in 1995, did.
The chart below shows what the 110th Congress accomplished before it closed for its August recess, compared with its immediate predecessor and with the Republican Congress that took office in 1995.

I know this must be a issue some of us would have faced. My wife's Birth certificate is in native language. I have got it translated from India on a stamp paper and notarized there itself.
Is this notarized paper a valid birth certificate for 485 ?
